Paddle Board Rental Agreement

This Rental Agreement (hereinafter referred to as the “Agreement”) is made and entered into by and between Rental Essentials LLC (hereinafter referred to as the “Company”) and the individual or entity renting the paddle board equipment (hereinafter referred to as the “Renter”). The Agreement sets forth the terms and conditions governing the rental of paddle boards by the Renter from the Company. By booking and renting our paddle boards, the Renter agrees to abide by the following terms:

Rental Essentials Paddle Board Rental Agreement

This Paddle Board Rental Agreement (hereinafter referred to as the “Agreement”) is entered into by and between Rental Essentials (hereinafter referred to as the “Rental Company”) and the customer (hereinafter referred to as the “Renter”) as of the date of signing this Agreement.

Rental Equipment

The Rental Company agrees to rent the following paddle board equipment (hereinafter referred to as the “Equipment”) to the Renter:

Rental Period:

A. The rental period begins on the date and time specified in the booking and ends on the return date and time specified in the booking.
B. The Renter agrees to return the paddle board(s) to the Company’s designated location on or before the agreed return date and time.

Rental Fee

The Renter agrees to pay the Rental Company the agreed-upon rental fee as follows:

Use of Rental Equipment

The Renter agrees that they are the only ones permitted to use the rental equipment during the rental period.

Age Restriction

The Renter must present valid photo i.d. and must be at least 18 years of age to rent and/or ride paddle boards.

Liability Waiver

The Liability Waiver will be sent with the confirmation email and must be read and signed before taking delivery of the paddle board rental.

Weight Limit

We currently use iRocker inflatable paddle boards. Weight limits must be followed and are listed by type of boards below.

The Renter shall make the full payment of the rental fee in advance upon signing this Agreement.

Condition of Equipment

The Renter acknowledges that they have inspected the Equipment and found it to be in good working condition and suitable for their intended use. The Renter agrees to return the Equipment in the same condition, dry of any water. and placed back inside the Paddle Board Back Pack.

Use and Care of Equipment

The Renter agrees to follow paddle boards recommended PSI, if below or above recommended PSI, may cause risk or damage. Board PSI is marked at the air valve. The Renter shall not make any modifications or alterations to the Equipment without the prior written consent of the Rental Company.

Loss, Damage, and Liability:

The Renter assumes full responsibility for the Equipment during the rental period. In the event of loss, theft, damage, or destruction of the Equipment, the Renter agrees to notify the Rental Company immediately and will be liable for the repair or replacement costs of the Equipment.

Lost/Damage

Indemnification

The Renter agrees to indemnify and hold the Rental Company harmless from any claims, damages, liabilities, costs, and expenses arising out of the Renter’s use or possession of the Equipment, including but not limited to personal injury, property damage, or any other loss.

Termination:

Either party may terminate this Agreement upon written notice to the other party. In the event of termination, the Renter agrees to return the Equipment promptly to the Rental Company and pay delivery and rental fee period.
Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of Texas. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Texas.

Entire Agreement:

This Agreement constitutes the entire understanding between the Rental Company and the Renter and supersedes all prior agreements, understandings, or representations, whether oral or written.

Severability:

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

By checking the box, the Rental Company and the Renter acknowledge that they have read and understood the terms and conditions of this Agreement and agree to be bound by them.

 

Return of Equipment:

A. The Renter agrees to return the paddle board(s) to the Company’s designated location at the end of the rental period.
B. The Renter acknowledges that any late return beyond the agreed-upon return date and time may incur additional charges.
C. The renter agrees to return the paddleboard(s) in the same condition as when they were received

Inspection and Damages:

A. The Renter agrees to inspect the paddle board(s) upon delivery and report any existing damages to the Company before use.
B. The Renter agrees to inspect the paddle board(s) upon return, in the presence of a Company representative, and report any new damages or loss incurred during the rental period.
C. The Renter acknowledges that they will be responsible for all costs associated with repairing or replacing any damages or loss caused during the rental period.

Cancellation and Refunds:

A. The Renter acknowledges that cancellations made within a specified time frame, as determined by the Company, may be eligible for a partial or full refund.
B. The Company reserves the right to cancel or modify any booking due to unforeseen circumstances, such as inclement weather or equipment unavailability. In such cases, a full refund will be provided to the Renter.

Our promotions are available for new customers only

The availability and location of our promotions are subject to change without notice. As a paddle board rental company, we strive to offer the best possible promotions to our customers. However, we reserve the right to modify or refuse promotions at any time to ensure that our services remain of the highest quality. We appreciate your understanding in this matter and look forward to providing you with the best possible service. By accepting any promotion, the customer agrees to these terms and conditions.

Governing Law and Jurisdiction:

This Agreement shall be governed by and construed in accordance with the laws of the state or country where the Company is located. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in that location.

By booking our paddle boards, the Renter acknowledges that they have read, understood, and agreed to abide by the terms and conditions set forth in this Rental Agreement. The Renter further acknowledges that they are solely responsible for their own safety while using the paddle board(s) and that the Company shall not be liable for any injuries, accidents, damages, or losses incurred during the rental period. The Renter agrees to release the Company from any liability arising out of the rental of the paddle board(s).
